There are various types of residence permits and two different ways to submit the application aimed at obtaining the degree.

Costs of the question

The amounts of contributions payable by foreigners of age are equal to:

  • receipt of payment of € 30.46 for the issue of the Residence Permit in electronic format (PSE) to be paid into the postal current account no. 67422402 in the name of the Ministry of Economy and Finance - Department of the Treasury with the purpose of "amount for the issue of the electronic residence permit";

The renewal of the residence permit must be requested at the Police Headquarters where the foreigner lives within the expiry of the permit or in any case no later than 60 days from the expiry date.

There are three types of Residence Permit for work:

A) Subordinated work

The residence permit has a maximum duration of:

  • 2 years if the employment contract is for an indefinite period
  • 1 year if the employment contract is for a fixed term

Documents to be attached

  • Stamp duty of 16.00 euros;
  • full copy of the passport bearing the entry visa;
  • n. 4 passport-size photographs of each person to be registered on the permit of
    living room;
  • the receipt of the payment of € 30.00 at the post office for expenses

  • the receipt of the payment of 70.46 euros (non-refundable in case of

    one year and less than or equal to two years.

Therefore, the postal order for the electronic permit request must be filled in with the following amounts:

  • Residence permit from 3 months to 1 year: € 70.46 (for a total of: € 70.46 + 30 + 16 = € 116.46)
  • Residence permit over 1 year and less than or equal to 2 years: 80.46 euros (for a total of: 80.46 + 30 + 16 = 126.46 €)
  • Residence permit over 2 years and company managers: 130.46 euros (for a total of: 130.46 + 30 + 16 = 176.46 €)

B) Seasonal Work

By 'seasonal' work we mean that carried out exclusively in the agricultural and tourism-hotel sectors.
You can obtain this type of residence permit if there is a request, by name or number, to: 

  • an Italian or foreign employer legally residing in Italy; 
  • trade associations on behalf of their members.

C) Self-employment

The Residence Permit for Self-Employment has a duration ranging from one to two years.

Documents to be attached

  • Stamp duty of 16.00 euros;
  • full copy of the passport bearing the entry visa;
  • n. 4 passport-size photographs of each person to be registered on the permit of
  • the receipt of the payment of € 30.00 at the post office for expenses
    shipping;
  • receipt of the payment of € 30.46 for the issue of residence permits
    in electronic format;
  • the receipt of the payment of 70.46 euros (non-refundable in case of
    denial) for a residence permit lasting more than three months e
    less than or equal to one year;
  • the receipt of the payment of 80.46 euros (non-refundable in case of
    denial) for the issue of a residence permit for a period exceeding
    one year and less than or equal to two years.

The residence permit for pending employment is issued when, at the time of the renewal of the residence permit for subordinate work reasons, the worker does not have an employment contract but is registered in the employment lists. The loss of the job is not a reason for the revocation of the residence permit for the non-EU worker and his legally residing family members.

The foreigner who loses his job following dismissal or resignation, must present himself, within 40 days from the date of termination of the employment relationship, at the Employment Center-Anagrafe del Lavoro and make a declaration certifying the activity previously performed work and the immediate availability to carry out work activities.

The foreigner who loses his job can be enrolled in the placement lists at the Employment Center for the residual validity period of the residence permit and, in any case, with the exception of the seasonal worker, for a total period of not less than one year or in any case for the entire duration of the income support benefits, during which you can look for a new job.

It is possible to register with the Employment Center-Anagrafe del Lavoro even if the residence permit has expired if you have the receipt / renewal slip.

The application for the issuance of the residence permit for pending employment must be submitted by filling in the Postal Kit which is used for renewal.

 

The residence permit for family reasons is issued in the case of a stay of more than three months: 

  • the foreigner in possession of a visa for family reunification or an entry visa following his family member or an entry visa for reunification with a minor child; 
  • to a foreigner residing in Italy in another capacity for at least one year who has married in Italy with an Italian citizen or a member state of the European Union or with a foreign citizen legally residing; 
  • to the foreigner already in possession of any valid residence permit (including for tourism), who wishes to reunite with a family member who is legally residing. In this case, your residence permit is converted into a residence permit for family reasons. The conversion takes place while staying in Italy, without therefore having to return to one's own country, and can be requested within one year from the expiry date of the residence permit originally held; 

 the foreign parent, even natural, of an Italian minor residing in Italy; 

 a foreign family member of a refugee, even if they do not have a valid residence permit.

Request for authorization for family reunification

The request for authorization for family reunification must be submitted by filling in the forms at the Single Immigration Desk (SUI) set up at the Prefecture.

Authorization can be requested in favor of:

  • a spouse who is not legally separated and is no less than 18 years old;
  • minor children also of the spouse or born out of wedlock, unmarried, provided that the other parent, if any, has given his consent;
  • dependent adult children, if they cannot provide for their own life needs due to their health conditions which entails total disability;
  • dependent parents who do not have other children in their country of origin or provenance, or parents over 65, if the other children of the National Social Security Institute are unable to support them for documented, serious health reasons;
  • of family members up to the 2nd degree of Italian citizen living with him;
  • of those who ask for family cohesion with their spouse or relative (in the case of dependent parents or disabled adult children) regularly residing with economic availability and accommodation complying with the provisions by converting their permit issued to another title.

Duration 

The permit for family reasons has the same duration as the residence permit of the relative to which it is related and is renewable together with the latter.

Requirements of the foreigner applying for reunification

The holder of the permit for family reasons can:
  • go to the countries of the Schengen Area for periods of less than three months without fulfilling any formal obligation and exempt from entry visa;
  • carry out subordinate work activities (the residence contract must be stipulated only if the permit is to be converted into a residence permit for work reasons);
  • The foreigner can submit an application for the granting of Italian citizenship after at least 10 years of uninterrupted legal residence in Italy or if 6 months have elapsed from the date of celebration of the marriage if the spouse is an Italian citizen;

Conversion of the residence permit

1. The residence permit of any other title can be converted into a permit for family reasons.

The following can request the conversion of the residence permit held into a permit for family reasons:

  • The foreigner who has contracted marriage in Italy and holds a residence permit for at least one year;
  • the legally resident alien (or within one year of the expiry of his permit), family member of a legally resident alien in possession of the requisites for reunification.

From 23 July 2016 (entry into force of the Law n. 122 of 7 July 2016) An individual residence permit for a foreign minor is issued to the minor child of foreign citizens.

The minor of fourteen, already registered in the residence permit of the foreign parent or the carer, will be issued with a new residence permit for foreign minors at the time of the renewal of the title by the parent. The cost for issuing / renewing / updating the permit is € 30.46.

At the age of 14, the minor has the right to be issued a residence permit for family reasons which is valid until reaching the age of majority.

Rights of minors

Foreign citizens can apply for an entry visa for "medical treatment" by applying to the Italian diplomatic or consular representation in their country. The application can be submitted by the interested party or by a family member or other representative.
After 8 days of entry, it is necessary to request the specific residence permit from the Police Headquarters of the place where you will have medical treatment.

Irregular Pregnant Women

The residence permit for medical treatment is also issued to irregular pregnant foreign citizens. The permit must be requested directly at the offices of the competent Police Headquarters with the presentation of a medical certificate with the presumed date of birth.
